Separating is never easy

Separating is never easy but you can choose not to make it harder than it needs to be

Separating from a long-term partner is never going to be easy, but kids aside, if you can come to an amicable agreement about how to divide your assets and liabilities, you really have most of the battle won.

The quickest way to document your arrangement is to use a Financial Agreement.

A Financial Agreement is a document made under Australia’s Family Law Act and some people will refer to it as a separation agreement.

There are two important parts to finalising your Financial Agreement and Property settlement:

Documenting your arrangement

The quickest way to document your arrangement is by using a Financial or Separation Agreement

  • Completing the Agreement
  • Getting the Required Legal Advice

We're going to show you how to complete your agreement and get the legal advice for just $1887 for both parties - without stress, fuss or engaging combative lawyers. We call it the Peaceful Path to Settlement!

Take the Peaceful Path to Settlement

In 2000, the Family Law Act introduced Binding Financial Agreements to lessen the load on the Family Court system.

The lawmakers recognised that the vast majority of couples could work out their own property settlement as long as there was a legal safety net to ensure equality in the bargaining power of the parties.

This safety net is the mandatory legal advice. Essentially both parties are required to have a conversation with a lawyer about their agreement to make sure that they each understand:

  •  The effect that signing the Financial Agreement will have on their rights; and
  •  The advantages and disadvantages of making the agreement.

Once they have done that - their lawyer is required to issue them with a Certificate of Legal Advice and the parties can sign the agreement and move on with their lives knowing that the property settlement has been completed legally

Once you've completed your draft agreement ($97), you and your partner can obtain the Legal Advice from qualified family law specialists at a low fixed price of $1790 for both parties (in most cases).
