In 2000, the Family Law Act introduced Binding Financial Agreements to lessen the load on the Family Court system.
The lawmakers recognised that the vast majority of couples could work out their own property settlement as long as there was a legal safety net to ensure equality in the bargaining power of the parties.
This safety net is the mandatory legal advice. Essentially both parties are required to have a conversation with a lawyer about their agreement to make sure that they each understand:
Once they have done that - their lawyer is required to issue them with a Certificate of Legal Advice and the parties can sign the agreement and move on with their lives knowing that the property settlement has been completed legally.
Once you've completed your draft agreement ($97), you and your partner can obtain the Legal Advice from qualified family law specialists at a low fixed price of $1790 for both parties (in most cases).
